Butler, Josephine E.
The Constitution Violated: an Essay

In 'The Constitution Violated' (1871), Butler stresses the unconstitutional nature of the Contagious Diseases Acts, shifting the discussion away from its usual emphasis on immorality. The Acts, she claims, infringe the constitutional rights of women, and violate the enduring principles of the Magna Carta. This new argument, couched in the language of individual rights and liberties, added a vital note of legal authority and respectability to the repeal campaign. The text played an important part in the eventual repeal of the Contagious Diseases Acts in 1886, but has been difficult to obtain in the original.
